3.2 All prices listed on the website exclude delivery fees. Delivery fees are shown separately on the order.

3.3 Prices may be displayed incorrectly due to internet or system update issues. Our company reserves the right of final interpretation for price changes.

For the avoidance of doubt, once we have accepted an order and formed a purchase contract under clause 6, we will not materially change the features and specifications of the product.

4.2 All product weights and dimensions described on the website are approximate.

5. Orders

5.1 You may place an order as described on the website. By placing an order, you make an offer to enter into an agreement (purchase) for the products subject to your order.

5.2 An order will be deemed received by vividthreadshop.com when vividthreadshop.com sends an order confirmation to the email address you have specified.

5.3 vividthreadshop.com is an online e-commerce store that primarily communicates with customers via email. It is your responsibility to ensure that your contact details are entered correctly and that you regularly check the designated email address for communications.

5.4 vividthreadshop.com reserves the right to refuse to enter into a purchase contract with you and may cancel your order at any time before the product(s) are dispatched.

5.5 If an order is cancelled, all funds relating to that order will be fully refunded. You will receive email confirmation of the cancellation and refund.

5.6 vividthreadshop.com accepts no responsibility for orders that are rejected, delayed, or not accepted due to internet connection interruptions.

5.7 vividthreadshop.com shall not be liable for any delay in performing any obligation caused by circumstances beyond the reasonable control of vividthreadshop.com (or its related companies), and vividthreadshop.com shall be entitled to a reasonable extension of time for performance.

5.8 vividthreadshop.com recommends that customers provide a secure delivery address, such as your workplace. vividthreadshop.com is not responsible for lost/stolen parcels.

6. Payment

6.1 You may provide your nominated credit card during the purchase process as described on the website.

6.2 Payment for the order will be processed immediately after your order is confirmed.

6.3 If your nominated payment method triggers our fraud prevention protocols, we may contact you to verify additional details or cancel the transaction. In such cases, your order will not be fulfilled unless it passes our fraud prevention protocols. If you do not provide the requested information within 7 days, your order will be cancelled and your payment refunded to your payment method. These information requests are intended to help protect credit card holders from online fraud.

6.4 Despite our best efforts, it is possible that a small number of products in our range on the website may be mispriced. If we have made a mistake and the correct price for a product is higher than the price on the website, we may contact you before dispatch to ask whether you wish to purchase the product at the correct price or cancel your order.

7. Delivery and Ownership of Goods

7.1 We endeavour to ensure all products are delivered promptly. However, delays may occur from time to time due to shipping and other factors beyond our control. vividthreadshop.com accepts no liability for any loss or damage suffered by any person as a result of such delay.

7.2 vividthreadshop.com aims to dispatch orders within 1–3 business days.

7.3 vividthreadshop.com does not deliver products to PO Box addresses.

7.4 The courier or postal service nominated by vividthreadshop.com will deliver products during local working hours (9am–5pm Monday to Friday, 9am–12pm Saturday).

7.5 vividthreadshop.com is not responsible for the delivery time of products. Once the product has been dispatched, it is your responsibility to contact the courier company nominated by vividthreadshop.com (as advised to you) regarding delivery date and time. vividthreadshop.com is not responsible for any inaccuracies in information provided to you about delivery dates and times. vividthreadshop.com accepts no liability for lost parcels during transit.

7.6 Faulty or damaged goods. vividthreadshop.com will repair, replace, or refund faulty or damaged products in accordance with your rights under the Australian Competition and Consumer Act 2010.

8. Refunds and Returns

8.1 Nothing in these terms and conditions excludes, restricts, or modifies any statute, including the consumer guarantees provided under the Australian Consumer Law.

8.3 All refunds may take up to 10 business days to finalise.

8.4 Except as provided under the returns policy, refunds are strictly limited to those available under the terms of any statute.

8.6 You must follow the instructions provided by staff to facilitate a return.

8.7 Products returned under the returns policy must be returned in their original, saleable condition. For the avoidance of doubt, nothing in this clause limits or restricts any claim you may have against us for failing to comply with a guarantee under the Australian Consumer Law. If you return a product due to a fault or defect under a guarantee in the Australian Competition and Consumer Act 2010, you may return the product without the original tags attached.

8.8 It is your responsibility to ensure that returned goods are returned safely. We accept no liability for products lost/damaged in transit.

8.9 Sale and promotional goods, including flash sale styles, can be returned for online credit (valid for 3 years) or exchanged if the product is in stock.

8.10 For final sale/non-refundable products returned due to change of mind, or products that do not meet the standards of the Australian Competition and Consumer Act 2010, the product will be returned to the sender via the marked address or through the original purchase order details if the parcel is unmarked.

Note: Returned product(s) must be received within 14 days of receiving the product, unworn, unwashed, unused, in original condition, with all tags/labels attached. For hygiene reasons, we do not accept returns of face masks, swimwear, or earrings unless a genuine manufacturing defect is shown. During sales periods, returns may take up to 10 days to process after receipt.

vividthreadshop.com does not accept postal returns of products purchased in-store.

vividthreadshop.com orders can be returned in-store, excluding sale, promotional, and “Outlet” products. You have 14 days to return purchased products. A copy of the order email is required to request a refund. Refunds will be issued to the original payment method.

9. Intellectual Property

All intellectual property in any material on the website is the property of vividthreadshop.com, and you must not copy, adapt, modify, display, perform, or distribute any material or any part of any material unless expressly authorised by these terms and conditions or otherwise.

10. Privacy

By placing an order or otherwise contacting vividthreadshop.com, you agree that we may store, process, and use data collected from your order for the purpose of processing your order. By placing an order or otherwise contacting us, you also agree that we may use such data (excluding credit card details) to inform you from time to time about other products that may interest you. For the avoidance of doubt, any such changes will operate prospectively from the time the revised terms and conditions are posted on the website and will not affect any purchase contract entered into before the date of the posting of the revised terms and conditions.

11.2 If any provision of these terms and conditions is invalid or unenforceable, it may be severed from these terms and conditions without affecting the enforceability of the remaining provisions.

11.3 Failure or delay by vividthreadshop.com to exercise a power or right under these terms and conditions does not operate as a waiver of that power or right, and the exercise of a power or right by vividthreadshop.com does not preclude its ability to exercise that power or any other power or right in the future.

11.4 To the extent they apply to ordering, purchasing, performing, and delivering products from vividthreadshop.com, the terms and conditions and the general terms and conditions are governed by the laws of Australia and must be interpreted according to those laws, and the parties submit to the jurisdiction of the courts of that country.

11.5 No employee or agent of vividthreadshop.com has authority to change any terms and conditions governing a sale.
